`Vasthu` analysed from a legal angle
VASTHU - A SCIENCE or SUPERSTITION
Nowadays in this country people are obsessed with `vasthu`. Architects are drawing plans keeping vasthu in view. Civil engineers are trying to restructure dams to comply with vasthu. Ministers change the structure of their official residences to bring them in conformity with vasthu at public expense. After the attack on Parliament by terrorists a theory was advanced that the Parliament building had to be altered as it violated vasthu norms.
Does Vasthu have any rational basis or is it just a superstition? The following analysis is an investigation into the question. The author confesses that he has not studied any standard book on vasthu as there is no rational basis to decide which is a standard book, and has depended only on opinions of lay men to ascertain the mandatory vasthu rules.
Whether vasthu affects the owner of a building
Let us assume that MrA, owns a house which is built against the vasthu norms on account of which he is suffering from misfortunes,. To save himself from the evil effects of vasthu- defects he executes an agreement of sale of the house in favour of Mr. B on 1- 1- 2003, delivers possession of the house on 1- 2- 2003 and executes a registered sale deed on 1- 3- 2003. From which date will the evil effects of vasthu stop troubling Mr. A and start troubling Mr.B? As per the law of the land, title is transferred only after registration of the sale deed. Whether the vasthu demigod [Vasthupurusha] goes to the sub-registrar's office to verify on what date the registration took place is a baffling question. Divorced from this legal angle, there is nothing like a natural right to private property.It may be surmised that in the Dictionary of God there is nothing like private ownership of property and everything belongs to God. To infer that the Vasthu Demigod does not spare even God, in the capacity of the ultimate owner of all property, is absurd. From the view point of a communist, every thing belongs to the entire human community.
Similarly, when there is a court case pending about the owner ship of the vasthu -defective house, will the Vasthu demigod suspend his `operation trouble` till the court decides who the owner is? What happens when the unsuccessful party files an appeal and the dispute drags on for decades up to the Supreme Court? If you wish to make the Vasthu demigod to fall into a dilemma and make him keep his fingers crossed, so as to keep vasthu generated evils at bay, the most economical way is to get a collusive suit for title filed in a court of law and allow the matter to drag on indefinitely, instead of spending lakhs of rupees in restructuringing the building.
Whether vasthu defects affect only the occupants and not the owner.
If we believe that the actual occupant and not the owner, will suffer the effects of vasthu violation, if the house of the neighbour violates vasthu norms, Mr. A will suffer the consequences though he is not the owner and therefore has no control over the structure of his neighbour`s house. This also leads to absurdities.
Is India condemned to suffer due to Vasthu violative physical features?
We are also warned grimly that since India has raised portions in the form of the Himalayas on its north east, and depression, filled with water on the south west due to the Arabian Sea and the Indian Ocean, this country is condemned to suffer from poverty and all possible evils. But it should not be forgotten that throughout a major portion of this country’s history, India was divided into small kingdoms, independent of one another. It is only after partition that this country as a single entity with the aforesaid Vasthu defects came into existence. Then why did this country fall prey to various foreign invaders, culminating in British Rule? It is to be hoped that we as a nation will get out-of-the vasthu fever and start thinking rationally.
As a last ditch effort, some die hard believers contend that Vasthu norms are valid in as much as they are laid down to ensure proper flow of air and light to the tenements, thereby ensuring good health of its inmates [though not owners]. Even this explanation is difficult to accept because the vasthu rules are not confined to the location of windows and ventilators, but extend to the placement of kitchen, water closet, prayer room, bed room, etc.
When this author discussed the above points with many believers in Vasthu, including leading lawyers possessing logical acumen, he was gravely warned that though no logically tenable answer could be given to such impious questions, Vasthu is nevertheless true.
