Micheal King Trial and The Idiots of Charlotte County Sheriff Department
There's an interesting wrongful death lawsuit going on in Florida that should have every lawyer and police department in the country's ears perked up.
In this particular lawsuit, the husband of a woman who was killed, has filed a wrongful death suit against the Charlotte County Sheriff's Office saying that they had information beforehand that could have saved his wife, but that the call to 911 was overlooked and never passed along to the deputies who were out looking for his wife. It was during that time that the criminal, Michael King, raped and murdered his wife before being caught.
The sheriff's office is trying to get the suit thrown out in what has to be an unbelievable bit of chutzpah, and definitely something that, if it works, will change the relationship between police and citizens forever. The sheriff's office is claiming that "the agency gave no specific promises it would protect Denise Amber Lee." This is coming through their attorneys. It goes further to say it would not be liable in Lee's death because no "special relationship" existed with her compared with the general public.
The incredulity of the statement is staggering. In essence, what the sheriff's office is saying is they have no real duty to protect any one person because that one person's life isn't worth any more than any other person's life. What ever happened to the statement "to serve and protect?" When did that suddenly become "depending on who it is at the time?"
When police departments across the country are asking for more cooperation for information in cases that go cold much quicker these days, it's amazing that this particular police department would even dare to make sure a statement. Even their own internal investigation found the dispatchers violated policies meant to take care of this sort of thing. A woman lost her life because of their incompetence. Many would would argue the Sheriff's department made the utmost egregious error of judgment that anyone could ever imagine.
If this suit is dismissed in favor of the sheriff's office, you can bet that anarchy will reign free, because what purpose would anyone have in contacting law enforcement for any reason whatsoever?
