Michigan Man Receives Life Sentence For Distribution of Child Porn
Instances of child abuse are taken very seriously, particularly if any sexual interaction is suspected. The relationship between the defendant and the child does not necessarily need to be physical to be illegal. Any experienced criminal child neglect and abuse lawyer in Michigan could attest, accusations of sexually exploiting kids in any way can bring serious criminal charges against you. Prison time is common in these cases. Such an example is seen in the recent case of a Michigan man recently sentenced to serve a life sentence for engaging in the creation and distribution of child pornography.
In January 2010, an out-of-state child porn investigation prompted police to raid the home of James Frazee, 53, and Patricia Podgajski, 45 in searching for sexually explicit content involving minors. The photographs discovered were traced back to an Internet web site maintained by Frazee between 2003-2007. According to his own testimony, he entered the world of kiddie porn seven years ago when he was first paid to take pictures of a then-eight year-old girl. He would then send the pictures to a contact out-of-state and post them online.
As a registered sex offender, the federal judge presiding over the case showed Frazee no mercy. After pleading guilty on April 6th to sexual exploitation of children charges, U.S. District Judge Dave Lawson sentenced him to serve a life sentence in Federal prison. Podgajski, who also was in the home, did not escape criminal charges. A Federal Grand Jury originally indicted her for a federal charge of sexually exploiting children, but the United States Attorney eventually dropped the charge. However, she eventually did plead guilty to second degree child abuse charges in Michigan, a felony. Like Frazee, she will almost certainly face substantial time behind bars for her involvement in this case.
As shown by this case of James Frazee and Patricia Podgajski, one does not need to have a physical contact with a minor to be accused of serious child abuse charges. Michigan prosecutors often charge defendants with Child Sexually Abusive Materials, Using a Computer to Commit a Crime and other similar charges. Conviction will undoubtedly follow a person around for life, tarnishing both their reputation and personal liberties. To fight these charges it is critical to find the child abuse & neglect lawyer in Michigan to defend you. Only highly trained and experienced defense attorneys can provide you with the best criminal defense in these cases. People being investigated for such crimes should speak with such an attorney before speaking with police.
