Divorce and custody battles can easily tear families apart. The troublesome situation all family members find themselves provides an opportunity for accusations to fly back and forth between the fighting parties–some are true, while many of are unfounded. Unfortunately, charges of child molestation or sexual actions against children are becoming more and more common, particularly in legal proceedings that involve parents fighting for custody. Child neglect and abuse in Michigan, as well as law enforcement officials take these allegations very seriously. While defense counsel recognizes the harsh consequences that can follow conviction of child molestation charges, police and agents of Children’s Protective Services (CPS) will respond to investigate the matter immediately.

Many people are inclined to automatically believe that accusations of sexual abuse against children are true, regardless of their accuracy. After all, why would any child make up a story like that? Actually, much has been studied and written about how these false allegations of sexual molestation of children arise. Many experts feel that in the context of divorce and custody battles in Michigan, children are often used as pawns by one parent against the other. Certainly, allegations of sexual assault on children will paint the accused parent in a negative light, making it difficult for them to retain their parental rights.

Those accused or being investigated for child molestation should immediately contact an experienced child abuse & neglect attorney in Michigan before speaking with anyone else–including CPS workers, family members, counselors, or clergy. Some of these individuals are required by law to report you to the police if they have reasonable suspicion that an inappropriate incident has occurred. Without an experienced defense attorney present, it is best to say nothing. Retaining knowledgeable counsel will ensure that superior legal advice and legal representation is used to protect both your reputation and your parental rights during intense divorce and custody battles.
